Surrogate Mella ESTATE OF WILLIAM G. BOLLINGER, Settlor (20-3569/C) — On the record, at the call of the calendar on December 2, 2022, at which counsel for Petitioners and counsel for Respondent Curtis G. Solsvig, III, appeared by virtual means, the court found that Solsvig, the trustee of the Bollinger Descendants’ Trust created by William G. Bollinger, willfully neglected or refused to obey this court’s October 6, 2021 order directing him to file an account of his proceedings and a petition for its judicial settlement. The court also found that Solsvig’s refusal to obey the court’s order prejudiced the rights of Petitioners. Based on that finding, Solsvig was adjudicated to be in contempt of court. In reaching this determination, the court noted that this matter had previously been before the court on October 4, 2022, at which time Solsvig appeared personally in the courtroom, and, with the consent of Petitioners’ counsel, who also appeared, sought an adjournment of the proceedings. The court granted the request and adjourned the matter to December 2nd, warning Solsvig that if his account was not filed by this date, he would likely be held in contempt, as he now has been. Solsvig will be allowed to purge his contempt, however, by filing and serving an account of his proceedings as trustee together with a petition for its judicial settlement no later than 28 days from the date that this decision and order, allowing him to purge his contempt, is served on him by overnight mail. Should Solsvig fail to purge himself of such contempt, a warrant of commitment will issue upon receipt by the court of an affidavit from Petitioners’ counsel stating that Solsvig has failed to file and serve such petition and account, together with proof of service of that affidavit upon Solsvig (see Matter of Soft, NYLJ, Mar 15, 2010, at 28, col 5 [Sur Ct, Bronx County]; Matter of Green, NYLJ, Oct 15, 2004, at 29, col 5 [Sur Ct, Kings County]).
