ESTATE OF JAMES CARL McGOWAN, Deceased (19-75/A) — Decedent James Carl McGowan died intestate on July 12, 2018. In this proceeding to settle the account of the New York County Public Administrator, as Administrator of his estate, alleged distributees appeared, objected, and sought to prove their status. A guardian ad litem was appointed for unknown distributees and certain alleged distributees whose whereabouts were unknown and provided a report with recommendations. At a kinship hearing before a court attorney-referee, the proof established that decedent was survived by four paternal-side first cousins and by ten maternal-side first cousins as his distributees. Accordingly, pursuant to EPTL 4-1.1 (a)(6), the net estate shall be divided into the maternal and paternal halves, and the paternal half further divided into four (4) equal shares and one (1) share distributed to each of the following persons: Grace Jean Dunbar, also known as Elsie Jean Dunbar, Helen Alderwood, Doris Marcellus, and Dr. John E. McGowan; and the maternal half shall be further divided into ten (10) equal shares and one (1) share distributed to each of the following persons: Richard Winston Lennox, Mary Carol Fairbairn, Debra Hyde, Lois Ann McShane, Linda Mary Churchill, Marilyn Eileen Benoit, Betty Jane Barkley, Linda Mae Hanes, Judy Anne Hanes, and William Arthur Hanes. ESTATE OF BETTY MARINARO, Deceased (19-1350/B/C/D) — This court grants this unopposed petition by Michael Marinaro, as the Administrator of the estate of Betty Marinaro, to collect and account for the proceeds of an award by the September 11th Victim Compensation Fund (the “VCF,” as authorized by Pub L 111-347, 124 Stat 3623 [2011], and further authorized by Pub L 116-34, 133 Stat 1040 [2019] [the "9/11 Acts"]). Decedent was in the “exposure zone” as defined by the 9/11 Acts and developed and died from Malignant Neoplasm of Renal Pelvis contracted through that exposure. The petition is granted and the proceeds are allocated in accordance with the VCF Award Detail. The restrictions contained in the Letters of Administration are modified and Petitioner is authorized to collect the award and execute any receipt and releases that may be required. Attorneys fees are fixed at a rate of 10 percent of the award as provided by the 9/11 Acts. Reimbursement for funeral expenses is waived.
