ESTATE OF JEFFREY W. AHN, JR., Deceased (12-2756/A/B/C) — The administrator’s application for leave to compromise causes of action for decedent’s wrongful death and conscious pain and suffering is granted. The restrictions contained in the letters issued to the administrator are modified to the extent necessary to effectuate the compromise, and she is authorized to collect the settlement and execute the necessary receipts and releases. The proceeds are allocated one hundred (100 percent) percent to the cause of action for conscious pain and suffering. The fees and disbursements of petitioner’s attorneys are fixed and determined, and petitioner has waived statutory commissions. The funeral expenses were paid by decedent’s parents and they have waived reimbursement. The balance of the settlement proceeds shall be distributed to decedent’s parents in accordance with EPTL 4-1.1(a)(4), as set forth in the decree. The account is settled, and the decree is signed.
