Surrogate Gingold ESTATE OF DEAN G. LORICH, a/k/a DEAN GERARD LORICH, Deceased (18-370/B) — In this proceeding to determine the validity of a claim (SCPA 1809) in the estate of Dean G. Lorich, petitioner’s counsel was given leave to withdraw on March 28, 2022. The proceeding was stayed 30 days from April 19, 2022, the date notice of entry of the decision was filed with the court, so that petitioner would have time to retain counsel or appear as a self-represented party. The court’s records indicate that respondent (executor) filed an answer on March 25, 2021, but there has been no activity since the stay ended more than a year ago. In view of the above, the court will dismiss the petition for failure to prosecute unless a motion for summary judgment or a note of issue is filed within 90 days of receipt of a copy of this decision (see SCPA 209[8]; CPLR 3216). The Clerk of the Court is directed to mail a copy of this decision, which constitutes the order of the court, by certified mail, to petitioner and counsel for respondent. Dated: June 14, 2023
