Surrogate Mella Decision & Orders signed: August 7, 2023

ESTATE OF JENIFER HEYWARD, Deceased (84-1659/B/C) — Albert J. Cardinali, to whom Letters of Trusteeship were issued for this trust created under the will of decedent Jenifer Heyward, filed a petition verified on October 19, 2021, seeking a decree granting him leave to resign as co-trustee and appointing Jeffrey R. Egan as successor co-trustee of the trust. Cardinali died before his petition was determined and his co-trustee, BNY Mellon, N.A., subsequently filed a petition for a decree appointing Egan as co-trustee to serve together with BNY Mellon. This latter petition has been granted by decree issued the same date as this decision. The court’s decree revokes the Letters of Trusteeship previously issued to Cardinale and directs the issuance of Successor Letters of Trusteeship to Egan. Accordingly, Cardinali’s petition for resignation and appointment of a successor trustee is dismissed as moot. This decision constitutes the order of the court Dated: August 7, 2023
