ESTATE OF XIU MING CHEN, Deceased (21-475/A/B/C) — The court grants this unopposed petition by Yong Hong Chen, as Administrator of the estate of Xiu Ming Chen to collect and account for the proceeds of an award by the September 11th Victim Compensation Fund (the “VCF,” as authorized by Pub L 111-347, 124 Stat 3623 [2011], and further authorized by Pub L 116-34, 133 Stat 1040 [2019] [the "9/11 Acts"]). Decedent, who was in the exposure zone as defined by the 9/11 Acts, died on January 9, 2018, from pancreatic cancer which she developed through her exposure during and in the aftermath of the terrorist attacks on September 11, 2001. Petitioner’s request to allocate the award in accordance with the VCF Award Detail is granted. The restrictions on the Letters of Administration issued by this court are modified, and Petitioner is authorized to collect the award proceeds and to execute any receipts and releases as may be required. Petitioner is authorized to pay himself and his brother, Yong Zhong Chen, each $9,545.00, as reimbursement for decedent’s funeral expenses. Attorneys fees are fixed at a rate of 10 percent of the award inclusive of disbursements, as provided by the 9/11 Acts. The balance of the sum awarded is distributed to decedent’s spouse, Zhen Jun Chen, and children, Yong Hong Chen and Yong Zhong Chen in accordance with EPTL 4-1.1 (a)(1) and 5-4.4. Decree setting Administrator’s account signed. Dated: September 7, 2023
