ESTATE OF EDWARD BENSON SAINT SAVAGE JONES, Deceased (12-2152/C) — Petitioner, the Administrator of the estate of Edward Benson Saint Savage Jones, brings this unopposed application to lift the restrictions on his letters which prohibit him from selling or transferring the estate’s real property without a court order. Decedent died intestate on May 30, 2012, survived by his mother as his sole distributee. Decedent held a remainder interest in certain real property, with the life interest held by his mother, who died on April 25, 2016. Petitioner seeks to lift the restrictions on his letters of administration in order to transfer the property directly to the distributees of the post-deceased beneficiary (decedent’s mother). This court notified petitioner’s counsel that the application would not be granted, as such transfer would, in effect, bypass the estate of decedent’s mother to the prejudice of possible creditors. The petitioner was granted time to either amend his application to reflect an appropriate sale or transfer to the mother’s estate, or to withdraw it. Since more than three years have elapsed since the court first notified counsel of the fatal problems with petitioner’s application, and no amendment or withdrawal having been filed by petitioner, the court hereby denies the instant application.
