ESTATE OF LAPRITA EASON, Deceased (17-617/A/B/C) — Lakita M. Eason has petitioned to remove Danielle C. Foreman as the Limited Administrator of the estate of their mother, Laprita Eason (SCPA 711), to appoint Petitioner as Administrator d.b.n. (SCPA 1007), and to direct Foreman to account for her proceedings as Administrator (SCPA 2205). A citation issued and was returnable before this court on July 12, 2023. The court has received proof of service of the citation on Respondent Danielle C. Foreman. No notices of appearances or submissions in opposition have been filed. The uncontested allegations contained in the petition, including that Danielle C. Foreman failed to notify the court when she relocated to another state, are due proof of the facts alleged (SCPA 509), and establish that Foreman is unfit to serve as fiduciary (SCPA 711 [6]). Accordingly, the petition is granted and the Limited Letters of Administration previously issued to Danielle C. Foreman shall be revoked. Limited Letters of Administration d.b.n shall issue to Lakita M. Eason upon her duly qualifying according to law. Danielle C. Foreman is ordered to account for her proceedings as Limited Administrator within ninety days from the date this decision and the decree of the court are served on her, with notice of entry. Foreman shall then cause citation to be issued and service to be made, without undue delay, on all persons interested in the accounting proceeding, pursuant to SCPA 2210. Decree revoking letters and directing appointment of administrator d.b.n. signed. Dated: October 12, 2023
