ESTATE OF WILLIAM WRIGHT, Deceased (13-226/G/H/I) — Before the court is the petition of the Administrator of the estate of William Wright, seeking authority to allocate, collect and distribute the net settlement proceeds of causes of action for decedent’s conscious pain and suffering and wrongful death. The compromise and settlement of the causes of action were approved by Order dated October 22, 2019, of the Honorable Manuel J. Mendez, of the New York County Supreme Court, where that action had been pending. That same Order fixed the fees and disbursements of Petitioner’s attorney and further directed that the settlement proceeds be held in an interest-bearing escrow account pending further order from this court regarding distribution. The instant petition is unopposed and is granted. The restrictions on Petitioner’s Letters of Administration are modified to the extent necessary to collect and distribute the net settlement proceeds. Petitioner’s request for the allocation of settlement proceeds 100 percent to the cause of action for conscious pain and suffering is granted. Reimbursement of funeral expenses and payment of statutory commissions (SCPA 2307) have been waived. The balance of the net settlement proceeds shall be paid as set forth in the Decree.1 Decree settling the Administrator’s account is signed. Dated: October 13, 2023
