Surrogate Gingold ESTATE OF SHUI YUK CHAN NG, Deceased (11-744/B/C/D) — In this uncontested compromise and accounting proceeding, the application is deficient. Counsel for petitioner was informed in 2015 that a fiduciary needed to be appointed for the estate of post-deceased distributee Nga Man Ng. As of today, the court has not been notified that a fiduciary was appointed for the estate of Nga Man Ng, nor has there been any filing in the above proceeding since 2014. In view of the above, the court will dismiss the proceeding for failure to prosecute unless an interested person takes affirmative action, such as by filing an amended petition, within 90 days of receipt of a copy of this decision (see SCPA 209[8]; CPLR 3216). The Clerk of the Court is directed to mail a copy of this decision, which constitutes the order of the court, by certified mail, to the interested parties. Dated: October 19, 2023

ESTATE OF DEAN G. LORICH, a/k/a DEAN GERARD LORICH, Deceased (18-370/B) — In this proceeding to determine the validity of a claim (SCPA 1809) in the estate of Dean G. Lorich, the court issued a decision and order on June 14, 2023 (hereinafter, the “decision”) stating that the proceeding would be dismissed for failure to prosecute unless a motion for summary judgment or a note of issue was filed within 90 days of receipt of a copy of the decision. The Clerk of the Court sent a copy of the decision to petitioner and counsel for the respondent by certified mail, but neither petitioner nor respondent sought to prosecute this matter as set forth in the decision. Accordingly, since more than 90 days have passed, the petition is dismissed, without prejudice, for failure to prosecute (SCPA 209[8]; CPLR 3216). This decision constitutes the order of the court. Dated: October 19, 2023
