ESTATE OF HELGA SCHNITKER, Deceased (21-4795/A/B/C) — The proposed compromise of causes of action related to decedent’s wrongful death and conscious pain and suffering against the settling defendants is approved. The restrictions contained in the Letters of Administration issued to the Administrator are modified to the extent necessary to collect and distribute these settlement proceeds. Petitioner’s request to allocate 100 percent of the settlement proceeds to conscious pain and suffering is granted. The Medicare-related claim asserted by the Centers for Medicare and Medicaid Services is allowed and may be paid as Petitioner requests. Likewise, the claims asserted by American Express and Spectrum are allowed and may be paid as Petitioner also requests. Attorneys fees and disbursements are approved in the amounts requested. Payment of statutory commissions (SCPA 2307) and reimbursement for funeral expenses have been waived. The balance of the settlement proceeds shall be paid as set forth in the Decree. Decree settling the Administrator’s account is signed. Dated: December 4, 2023
