ESTATE OF WILLIAM BOISE, Deceased (15-4629/A) — At the call of the calendar on January 30, 2024, for this motion to dismiss the petition of Cyril Okolie (hereinafter, “petitioner”) to probate a June 29, 2001, alleged will and for the award of sanctions against petitioner, movant Maurice Hyde (hereinafter, “movant”), Limited Administrator of the estate of William B. Boise, deceased, withdrew his request for sanctions against petitioner on the record. With the withdrawal of the request for sanctions on the record, the instant motion to dismiss the petition to probate the June 29, 2001, alleged will and for the issuance of Letters of Administration c.t.a. to petitioner is uncontested. Pursuant to SCPA 1402[1] petitioner lacks standing to propound the June 29, 2001, alleged will. Further, petitioner is not eligible to receive Letters of Administration c.t.a. pursuant to SCPA 1418. Accordingly, it is ORDERED that, movant’s request for the award of sanction is denied as moot; and it is further ORDERED that, the motion to dismiss the probate petition of the June 29, 2001, alleged will for letters of administration c.t.a. to issue to petitioner is granted. The clerk shall email a copy of this decision and order to counsel at the addresses below. Dated: February 5, 2024
