Surrogate Malave-Gonzalez ESTATE OF JUANITA ARTIS, Deceased (22-2917) — In this proceeding, one of the decedent’s daughters petitioned for limited letters of administration to pursue a cause of action. In addition to the petitioner, the distributees are a spouse and three other children. Jurisdiction was obtained over the three other children. It appears that the spouse, Emmanuel Odonkor (“Emmanuel”), is evading service as he stopped communicating with petitioner’s counsel after agreeing to accept service by mail. Despite the exercise of due diligence, however, Emmanuel could not be served at the post office box address in Ghana that he provided. Therefore, petitioner asks the court to dispense with obtaining jurisdiction over Emmanuel in this proceeding. On this state of the record, service on Emmanuel is dispensed with but jurisdiction shall be acquired over him in an accounting or other appropriate proceeding (SCPA 1003 [4]). Accordingly, the application is granted and limited letters of administration limited pursuant to SCPA 702 (1) with respect to any causes of action shall issue to petitioner. Decree signed. ESTATE OF LUIS ROSADO, Deceased (22-1918) — In this application by an alleged creditor for the issuance of letters of administration to an eligible distributee of the decedent or in the alternative, the Public Administrator, jurisdiction was obtained over the Public Administrator, the spouse and one of decedent’s three daughters. On the citation’s return date, the petitioner and the Public Administrator appeared through counsel on the court’s virtual platform. The decedent’s spouse and three daughters appeared pro se. Thereafter, on the record and in open court (i) the two daughters who had not been served waived the issuance of citation and any jurisdictional defenses, thereby completing jurisdiction in the matter; (ii) the spouse renounced her right to serve and consented to the appointment of one daughter, Carolina Rosado, as limited administrator; and (iii) the other two daughters and the Public Administrator consented to Carolina’s appointment. Accordingly, the application is granted. Letters of administration limited pursuant to SCPA 702(1) with respect to any cause of action shall issue to Carolina Rosado upon her duly qualifying.
