ESTATE OF JUAN B. RODRIGUEZ, Deceased (19-4641/A/B/C) — The court grants this unopposed petition by Rosa Rodriguez, as Administrator of the estate of Juan B. Rodriguez, to collect and account for an award by the September 11th Victim’s Compensation Fund (the “VCF,” as authorized by Pub L 111-347, 124 Stat 3623 [2011], and further authorized by Pub L 116-34, 133 Stat 1040 [2019] [the "9/11 Acts"]). Decedent, who was in the “exposure zone” as defined by the 9/11 Acts, died on September 9, 2019, from cancer, which he developed through his exposure during and in the aftermath of the terrorist attacks on September 11, 2001. Decedent is survived by Petitioner, his wife and sole distributee. The record further reflects that decedent was 75 years old at the time of his death. Petitioner’s request that the award be allocated in accordance with the VCF Award Detail is granted. The restrictions contained in the Letters of Administration are modified to allow the actions described here and Petitioner is authorized to collect the award and execute any receipts and releases that may be required. Attorneys fees are fixed at a rate of 10 percent of the award inclusive of disbursements, as provided by the 911 Acts. The net award shall be distributed as set forth in the Decree.
