Surrogate Gingold ESTATE OF NORAYR BABOUMIAN, Deceased (17-3592) — Petitioner Damaris Padilla, the executor named in decedent’s will, filed this probate proceeding on September 19, 2017. On October 14, 2021, a status conference was held with the court in which Shaunte Baboumian, the decedent’s sole distributee and a specific beneficiary under the will, requested pre-objection discovery pursuant to SCPA 1404. On November 18, 2021, the parties submitted a stipulation scheduling pre-objection discovery and setting a deadline for Ms. Baboumian to file objections by December 30, 2021. No objections were filed and on November 28, 2023, the court issued an order directing the parties to settle decree or the petition would be dismissed as abandoned. Respondent Shaunte Baboumian now moves, by order to show cause, to vacate the court’s November 28, 2023 order and to allow additional time to complete pre-objection discovery. The motion is unopposed. On March 29, 2024, petitioner and respondent Shaunte Baboumian appeared on the return date of the motion and indicated that the motion had been resolved by stipulation. The parties also requested a settlement conference with the court. The Attorney General’s Office did not appear. Accordingly, it is ORDERED that the motion is granted; and it is further ORDERED that the order dated November 28, 2023 is vacated; and it is further ORDERED that the deposition of the executor shall be held by May 15, 2024; and it is further ORDERED that any verified objections shall be filed and served by May 28, 2024 and jurisdiction pursuant to SCPA 1411 shall be promptly obtained; and it is further ORDERED that all parties shall appear for a settlement conference with the court on April 17, 2024 at 11:00 a.m. in courtroom 509, 31 Chambers Street, New York, New York; and it is further ORDERED that petitioner, who lives out of state, may appear virtually for the settlement conference and a Teams link will be sent prior to the conference.
