ESTATE OF GILBERT SCOTT-HERON, a/k/a GIL SCOTT-HERON, Deceased (11-2283/L) — At the call of the calendar on April 23, 2024, the court denied Chegianna Scott-Heron Newton’s petition to punish Rumal Rackley (Rackley), the Temporary Administrator of the estate of Gilbert Scott-Heron, for contempt for failing to comply with this court’s Decision and Order dated March 14, 2023, which directed him to file an account and petition for its judicial settlement within 90 days from service of the order upon him. The contempt petition was denied because Rackley filed the required account and petition for judicial settlement on February 5, 2024, prior to the issuance of process in the contempt proceeding on February 26, 2024 (see Matter of Harvey, NYLJ, June 2, 2017, at 27, col 6 [Sur Ct, NY County]; Matter of Demaria, NYLJ, Jan. 23, 2014, at 22, col 5 [Sur Ct, NY County]). This decision, together with the transcript of the April 23, 2024 proceedings, constitutes the order of the court. Clerk to notify.
