Decision and Orders signed: June 26, 2024   Surrogate Gingold ESTATE OF DIANE KAUFMAN FREDETTE, Deceased (21-3673/A/B/C) — The administrator cta of the estate of Diane Kaufman Fredette seeks permission to collect and distribute the proceeds of a recovery from the September 11th Victim Compensation Fund (“VCF”) and further seeks judicial settlement of his account with respect to such proceeds. The administrator cta’s petition is granted. The restrictions contained in the letters issued to him are modified to the extent necessary to allow the collection of the VCF award, and he is authorized to collect the amount due from the VCF and to execute the necessary receipts and releases. The award proceeds are allocated as requested in the petition, and in accordance with the VCF Award Detail. The fees of petitioner’s attorney are fixed and determined. Funeral expenses have been paid by decedent’s spouse, and he has waived reimbursement. The balance of the settlement proceeds shall be distributed in accordance with the provisions of decedent’s will and EPTL 5-4.4, as set forth in the decree. The account is settled, and the decree is signed. Dated: June 26, 2024 Surrogate Mella ESTATE OF ELLEN deJONGE OZERI, Grantor, Deceased (21-2364/C) — In the above-captioned proceeding by Zion Ozeri to compel a distribution from the Ellen deJonge Ozeri Revocable Trust established by decedent Ellen deJonge Ozeri, all parties, none of whom is under a disability, have executed a stipulation discontinuing it with prejudice and without imposition of costs and fees, which has been filed with the court (CPLR 3217[a][2]).
