Decision and Orders signed: July 10 & 11, 2024 Surrogate Mella

ESTATE OF WILLIAM DODGE, a/k/a WILLIAM ELLIOT DODGE, Deceased (21-1016/A/B/C) — This court grants this unopposed petition by the Administrator of decedent’s estate for leave to collect and account for the proceeds of an award by the September 11th Victim Compensation Fund (the “VCF,” as authorized by Pub L 111-347, 124 Stat 3623 [2011], and further authorized by Pub L 116-34, 133 Stat 1040 [2019] [the "9/11 Acts"]). Decedent was in the “exposure zone” as defined by the 9/11 Acts and developed and died from malignant neoplasm of the colon with metastases contracted through that exposure. Petitioner’s request to allocate the award proceeds in accordance with the VCF Award Detail is approved. The restrictions contained in the Letters of Administration are modified to allow Petitioner to collect the proceeds and to execute any receipt and releases that may be required. Attorneys fees are fixed at a rate of 7 percent of the Award, pursuant counsel’s signed retainer letter, as requested in the petition, which is less than the 10 percent cap allowed by the VCF. Reimbursement for funeral expenses is approved. The net award proceeds shall be distributed as set forth in the Decree and pursuant to EPTL 5-4.4 and 4-1.1 (a)(3). Decree settling the Administrator’s account is signed. Dated: July 9, 2024
