ESTATE OF DAVID JUSTUS, Deceased (20-1550/A/B/C) — The court grants this unopposed petition by Rachel Justus, as Executor of the Estate of David Justus, to account for an award by the September 11th Victim Compensation Fund (the “VCF,” as authorized by Pub L 111-347, 124 Stat 3623 [2011], and further authorized by Pub L 116-34, 133 Stat 1040 [2019] [the ""9/11 Acts"]). Decedent, who was in the “exposure zone” as defined by the 9/11 Acts, died on March 26, 2020, from brain cancer which developed through his exposure during and in the aftermath of the terrorist attacks on September 11, 2001. Decedent is survived by his spouse and two minor children. The record further reflects that decedent was 51 years old at the time of his death and was a First Responder. Petitioner’s request to distribute the proceeds in accordance with the VCF Detail Award is granted. The restrictions contained in the Letters Testamentary arc modified to allow this distribution and petitioner is authorized to collect the award and execute any receipts and releases that may be required. Attorneys fees are fixed at a rate of 10 percent of the award inclusive of disbursements, as provided by the 911 Acts. The net award shall be distributed as set forth in the Decree. Decree settling Administrator’s account signed. Dated: July 11, 2024
