ESTATE OF ELEANOR JOHNSON, Deceased (20-2022/A/B/C) — The petition by the Administrator of the Estate of Eleanor Johnson for leave to compromise a cause of action for decedent’s personal injuries is granted. The restrictions contained in the Letters issued to the Administrator are modified to the extent necessary to allow this compromise, and the Administrator is authorized to collect the settlement and execute the necessary receipts and releases. The settlement proceeds are allocated as follows: 100 percent to the cause of action for personal injuries. The fees and disbursements of petitioner’s attorney are fixed and determined as set forth in the decree. The Administrator is authorized to pay himself the sum of $11,595.75 as reimbursement for decedent’s funeral expenses. The statutory commissions of petitioner for his services as Administrator of the Estate of Eleanor Johnson are fixed and determined as set forth in the decree. The Administrator is further authorized to pay the following sums in full satisfaction of their corresponding claims: $127,394.87 to the New York City Department of Social Services; $98,451.60 to Centers for Medicare and Medicaid Services; $3,062.50 to Law Office of Paul R. King; $6,183.48 to Maldonado & Cruz PLLC. The balance of the settlement proceeds shall be distributed to decedent’s distributees pursuant to EPTL 4-1.1 as set forth in the decree.
