Recitation, as required by CPLR §2219(a), of the papers considered in the review of this Motion Papers Numbered Notice of Motion and Affidavits Annexed 1 Order to Show Cause Answering Affidavits 2 Replying Affidavits Exhibits Supplemental Affidavit DECISION/ORDER Upon the foregoing papers, plaintiff’s motion to compel non-party FENDI to furnish Social Security number of defendant, is decided as follows: Plaintiff’s had commenced an action against defendant, Mona Mohammad. Plaintiff was able to obtain a default judgment against the defendant in the amount of $8,687.48 in 2013. Plaintiff had served a subpoena on a third party, FENDI, who is apparently defendant’s employer. The plaintiff had attempted to garnish defendant’s wages, but had an incorrect Social Security number. FENDI has declined to furnish defendant’s Social Security number. Social Security numbers were first adopted in 1936, when the nine-digit account numbers were assigned for the purpose of administering the Social Security laws. Federal law provides that Social Security numbers shall be confidential, and no person authorized to maintain these records and numbers, shall disclose them, Meyerson v. Prime Realty Services, 7 Misc. 3d 911 (Sup. Ct. New York Co. 2016), see also Bibeau v. Cantiague Figure Skating Club, Inc. The Court at this time denies the relief requested, without prejudice since the defendant was not served with a copy of this motion. The Court is also concerned since FENDI is not a party to this action. This constitutes the decision and order of the Court. Dated: August 2, 2024
