Decision and Orders signed: September 9, 2024 Surrogate Mella

ESTATE OF MURRAY MELNICK, Deceased (04-0355/P/Q/R) — The Administrator’s petition for leave to allocate and distribute the net settlement proceeds from causes of action for decedent’s conscious pain and suffering and wrongful death which were settled in the Supreme Court, New York County against defendant Owens Illinois Trust is granted. The restrictions on the Letters of Administration issued by this court are modified. The Administrator is authorized to collect the compromise proceeds and to execute such receipts and releasees as may be required. The settlement proceeds are allocated 100 percent to the cause of action for decedent’s conscious pain and suffering and the action for decedent’s wrongful death is discontinued without interest cost or disbursements. The net proceeds shall be paid to Petitioner, who is decedent’s son and sole distributee, as proposed in the petition, pursuant to EPTL 4-1.1 Decree settling Administrator’s account signed. Dated: September 9, 2024
