Decision/Order of Judge Claimant appeared pro-se, and defendant appeared by owner Ms. Soto. Claimant was accompanied by a non-party witness, her mother, Monica Foster, listed as Owner of the dog. Claimant testified that she took her elderly dog, Bailey, to defendant for two years prior to the incident at issue. Since she worked, her mother usually took the dog in for visits and he loved Ms. Soto. Bailey died on March, 2024 unrelated to this action as he was suffering from kidney failure. Claimant testified that she is seeking return of the cost of the grooming services and the cost of veterinary bills as she claims her dog became ill from the services and the grooming equipment. Defendant Soto testified in her defense, the she groomed Bailey for over 2 years without incident, treated him well and did the grooming personally according to protocol without incident. Had she been contacted by claimant, she would have refunded the service fee but adamantly states bailey’s issue did not result from her grooming. Claimant produced photos and documents that showed she is not the owner of Bailey. No certified medical documentation for Bailey’s illness was submitted. Hence, claimant failed to prove a prima facie case. Based on credible testimony and evidence, the claim is dismissed and judgment is entered in favor of the defendant. This constitutes the Decision and Order of the Court. Dated: September 12, 2024
