ESTATE OF TONY MARSHALL, Deceased (18-4488/D/E/F) — The court grants this unopposed petition by Laurie Lasdon Marshall, as Administrator of the estate of Tony Marshall, to collect and account for an additional award by the September 11th Victim Compensation Fund (the “VCF,” as authorized by Pub L 111-347, 124 Stat 3623 [2011], and further authorized by Pub L 116-34, 133 Stat 1040 [2019] [the "9/11 Acts"]). By prior decree of the court dated March 23, 2022, the court settled the Administrator’s account for the initial award, and thereafter the VCF issued an amended award, the proceeds from which Petitioner, decedent’s spouse, now seeks to allocate and distribute. Decedent, who was in the “exposure zone” as defined by the 9/11 Acts, died on January 19, 2013, from lymphoma which developed through his exposure in the aftermath of the terrorist attacks on September 11, 2001. The record reflects that decedent was 72 years old at the time of his death. Decedent was survived by his spouse and daughter. Funeral expenses were paid by the prior award. There are no additional claims. The proceeds are allocated in accordance with the amended VCF Award Detail. The Administrator seeks to distribute the net award proceeds, after payment of attorneys fees, to decedent’s daughter. That request is granted. Attorneys fees are fixed at a rate of 10 percent of the award inclusive of disbursements, as provided by the 9/11 Acts. No statutory commissions are available on these proceeds (SCPA 2307[2]). The Administrator’s account is settled. The restrictions contained in the Letters of Administration are modified, and Petitioner is authorized to collect the award proceeds and to execute any receipts and releases that may be required.
