ESTATE OF CHUNG TING YUEN, Deceased (19-3381/D/E/F) — The petition by the Administrator of the Estate of Chung Ting Yuen to modify the restrictions on his letters to allow him to collect and distribute additional proceeds from the September 11th Victim Compensation Fund (“the VCF”) on account of decedent’s conscious pain and suffering and wrongful death and to judicially settle his Account with respect to those additional proceeds is granted. The restrictions contained in the letters issued to the Administrator are further modified, and the Administrator is authorized to collect and distribute the additional proceeds and to execute the necessary receipts and releases. The award proceeds are allocated as requested in the petition and in accordance with the VCF Award Detail of March 31, 2023. The fees of petitioner’s attorney are fixed and determined as set forth in the decree. Reimbursement to the funeral creditor for decedent’s funeral expenses was incorporated into the prior VCF Award Detail of July 27, 2020 and already distributed. Petitioner is not entitled to statutory commissions under SCPA 2307. The balance of the award proceeds shall be distributed to the estate of decedent’s spouse as set forth in the decree. The Account is settled, and the decree is signed. The Clerk of the Court shall serve a copy of this decision to counsel for the petitioner in the proceeding by email at the address below.
