ESTATE OF ILONA CHERNY, Deceased (16-2855/A) — In this turnover proceeding, the Guardian Ad Litem (the “GAL”) appointed for infant parties moves, by order to show cause, for an order: (i) directing J.P. Morgan Bank, N.A. (the “Bank”) to comply with a previous stipulation, dated July 25, 2023 and so-ordered on August 2023, authorizing the issuance of a check in the amount of $5,600.00 to Applied Forensics, the GAL’s handwriting expert, payable from the infants’ restrained custodial accounts in equal shares; (ii) requiring the Bank to pay the GAL’s legal fees associated with this application; and (iii) vacating the Note of Issue and Certificate of Readiness filed herein. Jurisdiction has been obtained over the necessary parties to the matter, who appeared through counsel on the return date of process. After conferencing with a member of the court’s Law Department, all counsel consented, on the record and in open court, to the relief sought by the GAL’s application. Subsequently, it was reported to the court that the Bank released the $5,600.00 payment to Applied Forensics as requested and reached an agreement with the GAL regarding the reimbursement of his legal fee. Furthermore, the petitioner and respondents in this proceeding have entered into a written discovery schedule. Accordingly, this matter is marked “settled.” The parties to the proceeding are directed to appear for an off-calendar conference with court attorney John J. ESTATE OF NANCY C. WATSON, also known as NANCY WATSON, Deceased (20-308/B) — On the return date of this application by a beneficiary under the decedent’s will seeking to compel the testator to account, the testator appeared and consented to the entry of a 30 day order. The respondent received letters testamentary on November 9, 2021 and there does not appear to be any reason why she cannot render an account. Accordingly, the application is granted. The respondent shall file her account, a petition for its judicial settlement and all of the papers required to obtain the issuance of a citation in the accounting proceeding within thirty (30) days of personal service upon her of a certified copy of this decision, which constitutes the order of the court. The respondent shall then, without delay, obtain jurisdiction over all of the necessary parties in the accounting proceeding pursuant to SCPA 2210, and shall appear before the court from time to time as required for the purpose of the settlement of her account.
