ESTATE OF TANYA J. CORBIN, Deceased (09-0437.1) — In this formerly contested executor’s accounting for the Estate of Tanya J. Corbin, the court issued two decisions in response to cross-motions for summary judgment filed by Steven B. Silverman (Executor), and David Corbin and Young Hee Ko (Objectants), respectively. The first decision, issued on March 25, 2024, (March 25th Decision) denied the Objectants’ motion in its entirety and granted the Executor’s motion to the extent of dismissing certain objections in the pleadings with prejudice. The March 25th Decision also granted a conditional order by which Objectants would face sanctions for failure to comply with specific discovery-related directions. As Objectants did fail to comply with same, the court issued a second decision on June 11, 2024 (June 11th Decision) dismissing all remaining objections with prejudice, and deeming all issues resolved in accordance with the Executor’s claims. The Decisions render the case procedurally ready for the settlement of a decree seeking approval of the Executor’s Account for the period from decedent’s death on July 24, 2008 to June 30, 2014. However, since the issuance of the June 11th Decision, the court has made several attempts to confirm the status of the settlement of a decree in this proceeding and, to this date, no such decree has been submitted. Accordingly, it is hereby ORDERED that the Executor has 60 days from the date of this decision to settle the decree in this matter (22 NYCRR 207.37 [a]); and it is further ORDERED that upon the Executor’s failure to settle the decree within the allowed time this matter will be discontinued (CPLR 3217 [b]). The Clerk of this Court shall mail a copy of this decision, which constitutes the order of the court, to the parties named below. Dated: January 9, 2025
