ESTATE OF XIAOGENG SONG, Deceased (18-2136/A) — Incident to the settlement of his account, the Ancillary Administrator in New York for the estate of decedent Xiaogeng Song, who died a domiciliary of England, requests authority under SCPA 1610(3) to pay the net estate directly to the decedent’s distributees, his two parents, who reside in Canada. The English solicitor who represented the decedent’s mother as domiciliary administrator in England provided an affidavit in support of the requested relief confirming that the administration of the decedent’s estate concluded in England in August of 2017, and that further distributions to the domiciliary estate would generate “unnecessary costs.” The application is unopposed and the New York State Department of Taxation and Finance executed and filed a consent to the relief requested. The court grants the Ancillary Administrator authority to distribute the net New York estate directly to the distributees to avoid “delay and circuity” that may be occasioned by a direction that the New York estate be paid to the domiciliary estate fiduciary in this instance (Matter of Horwich, 10 Misc 2d 79, 81 [Sur Ct, NY County 1957]). The account is settled, and the decree signed. Dated: January 10, 2025
