Decision and Orders signed: January 16, 2025 Surrogate Gingold

ESTATE OF THOMAS J. LAMBERT, a/k/a THOMAS JOHN LAMBERT, Deceased (22-2871/A) — Incident to her final accounting in the Estate of Thomas J. Lambert, the Public Administrator requests a determination of the identity of decedent’s distributees. Based upon the proof submitted at a hearing before a court attorney-referee, in which a guardian ad litem for unknown distributees participated, the court finds that decedent was survived by a spouse, who post-deceased, and two children. The court is satisfied that diligent and exhaustive efforts have been made, without success, to ascertain the existence of other distributees, that more than three years have elapsed since decedent’s death, and that no claim to a distributive share in the decedent’s Estate has been made by any other person. It is therefore determined that no other distributees exist (SCPA 2225). The final report of the guardian ad litem indicates that she is satisfied that the identity of the decedent’s distributees has been established. Accordingly, the Public Administrator is directed to distribute of the net estate, pursuant to EPTL 4-1.1(a)(1), fifty thousand dollars and one-half of the residue to the estate of the decedent’s post-deceased spouse: the Estate of Inez v. Lambert, a/k/a Inez Vicuna Lambert, and the remaining one-half of the residue in equal shares to the two children: Ann Marie Scanlon and McGuire Casey Andrew Lambert. The Public Administrator shall supplement her account by affidavit and, as so supplemented, the account is settled. Settle decree. The Clerk of the Court shall serve a copy of this decision to all parties in this proceeding by email at the addresses below. Dated: January 16, 2025
