“MJP” is back on the agenda. The American Bar Association Commission on Multijurisdictional Practice (ABA Commission) has issued its interim report and recommendations, and is seeking public comment. Already arrayed against the proposals of the ABA Commission is a fast-growing coalition of bar organizations – including, as a supporter if the coalition’s approach, although not a formal member, the Association of the Bar of the City of New York.
This coalition, whose active members include groups that are often adversarial, such as the National Organization of Bar Counsel (NOBC) – the group comprising staff counsel of the states’ professional disciplinary bodies; the Association of Professional Responsibility Lawyers (APRL) – a group that includes many lawyers who represent lawyers being disciplined; and the Association of Corporate Counsel of America (ACCA) – the group representing in-house counsel of U.S. corporations (i.e., the profession’s largest clients). This coalition has developed its own “Common Sense Proposal for Multijurisdictional Practice” as an alternative to the approach of the ABA Commission. Most recently, the coalition was joined by the Colorado Bar Association, the first of what the coalition hopes will soon be many state bar associations to join.
