Medical malpractice cases brought in Long Island courts often reach the Appellate Division, Second Department.[1] Recent decisions issued by the Second Department on appeal in these matters have focused on a wide range of issues.

In one case, the plaintiff failed to timely comply with a 90-day notice served pursuant to CPLR 3216 by several defendants. The plaintiff also failed to move for an extension of the 90-day period. The trial court therefore dismissed the complaint, and the plaintiff appealed.
