Land Use – Civic Association’s Right to Intervene in Zoning Fight Over Proposed Retail Fashion Mall – Competitor May Fund Community Opposition to Rival Project

Certain neighborhood civic associations moved to intervene in an Art. 78 proceeding, the petitioners sought to annul as arbitrary and capricious, a decision by a Town Board that denied petitioners’ application for a special use permit to construct a retail fashion mall, based upon concerns as to, inter alia, traffic and economic impact upon existing stores.
