The Eleventh Circuit recently ruled that a predatory pricing claim was properly dismissed because the evidence would not support a finding that the defendant’s losses could be recouped from subsequent elevated pricing. The Federal Trade Commission challenged the activities of a trade association formed by a group of obstetricians to represent their interests in negotiations with health insurers. Other key antitrust cases decided recently include a Second Circuit ruling upholding U.S. antitrust jurisdiction in a case challenging conspiratorial commission-setting by auctioneers in foreign as well as domestic auctions.
