ALBANY – A woman who waited 12 years for the backlogged state Division of Human Rights to resolve her sex discrimination claim is entitled to prejudgment interest, the Court of Appeals said yesterday in reversing a downstate appellate panel.
The judges in Albany agreed unanimously that while prejudgment interest on a discrimination claim is not automatic, the denial of that benefit can constitute an abuse of discretion – as it did here.
