CENTRAL ISLIP – Acting Supreme Court Justice Marion McNulty has permitted a mother to move her two sons to Florida, citing her ex-husband’s failure to pay support as a dominant factor in the determination.

In Ferreiro v. Ferreiro, 98-21742, Justice McNulty found that the father’s refusal to pay child support was “of such an extreme nature as to warrant the Court’s finding that it is in the best interests of the children that they be permitted to relocate with their mother.” (The decision is published in today’s Law Journal.)
