“The scenario defendants suggest would have lead and associate counsel responsible for every aspect of a capital defense, even such simple tasks as assembly and filing papers in court, which would be a waste of resources,” the Court said.
ALBANY – The Court of Appeals yesterday upheld its own power to establish a rate structure for capital defense and found that the state is responsible for paying lawyers and paralegals to whom various chores are delegated by the assigned death counsel.
