MINEOLA – A former partner of a Garden City-based firm has defeated a motion seeking to dismiss as untimely his claims alleging that he was not fairly compensated after he left the practice more than six years ago.

State Supreme Court Justice Geoffrey O’Connell ruled that Thomas M. Lamberti could move forward with his causes of action against Cullen and Dykman and its principals for breach of contract and breach of fiduciary duty. Mr. Lamberti also is seeking the imposition of a constructive trust.
