HISTORICALLY, New York has had one of the nation’s most comprehensive and complex systems for policing and regulating the provision of health care. As a result, the laws and regulations that apply to health care operations in New York are also comprehensive and complex.

Attorneys representing providers, insurers, patients and other players in the health care industry must be familiar with the many rules that are applicable to their clients. Even experienced attorneys, however, are sometimes not aware of lesser-known statutes or regulations that, while seldom invoked, are very much in effect. These statutes and regulations lie buried in the landscape like land mines, and ignorance of their detonation potential can have significant adverse effects.
