A federal appeals court will review, before discovery can proceed, New York City’s claims that it and contractors are immune from suit by thousands of workers who claim they contracted respiratory illnesses during the cleanup of the World Trade Center site.
Southern District of New York Judge Alvin Hellerstein had ruled that a decision on the immunity issue was premature and outlined “core discovery” to be conducted in the meantime.
