Limiting the Scope of Honest Services Fraud

Evan T. Barr, a partner at Steptoe & Johnson, writes that in recent years, federal prosecutors have used the honest services fraud theory to criminalize a wide array of misconduct by public officials. Under the theory, prosecutors have applied the mail and wire fraud statutes to schemes to "deprive another of the intangible right of honest services."
