A medical school’s policy permitting only students, their spouses and dependent children to reside in college-subsidized housing does not violate the State and City Human Rights Laws and does not discriminate on the basis of sexual orientation, a state judge has ruled.

Acting Supreme Court Justice Franklin R. Weissberg rejected the claim of two lesbian students who charged that the housing policy at Albert Einstein College of Medicine had a disparate impact on homosexuals and granted the defendant’s motion to dismiss in Levin v. Yeshiva University (Index No. 111261/98).
