Parties to disputes that arise from international transactions often end up litigating in more than one forum in more than one country. While U.S. courts are generally tolerant of parallel proceedings in other forums involving the same parties and same dispute, under certain circumstances they will grant “anti-suit injunctions” enjoining the parties from pursuing resolution of their dispute in another forum.
U.S. courts recognize that, although such injunctions technically apply only to the litigants, as a practical matter, they impinge upon the jurisdiction and authority of a tribunal in another country. As a result, U.S. courts do not grant such relief lightly.
