An Australian couple can proceed with a lawsuit that alleges their idea for a shape-shifting creature was used without permission in the film "Terminator 2: Judgment Day," a 9th Circuit panel has ruled. Filia and Constantinos Kourtis claim that they came up with the character in 1987, for a movie called "The Minotaur." The "Terminator" film, which starred California Gov. Arnold Schwarzenegger before he entered politics, was released in 1991 and featured a character that can transform its appearance.

AP _ Former Wal-Mart Stores Inc. executive Thomas Coughlin is asking for a hearing on an appeals court ruling that could mean he will face a prison term rather than home confinement for fraud and tax evasion.Coughlin, who was once the No. 2 executive at Wal-Mart, filed papers Tuesday seeking to overturn an appeals court panel's order that the trial court conduct a new sentencing hearing.
