The New Jersey Supreme Court will not review an award of attorney fees against Chicago Title Insurance Co. for declining to indemnify an investor who bought up former railroad properties that turned out to be lacking the requisite government approval.

The court on Oct. 5 denied a petition for certification in 212 Marin Boulevard LLC v. Chicago Title Insurance Co., in which an appeals panel upheld a $1.7 million sum already awarded and said the plaintiffs are entitled to additional fees incurred in connection with the coverage dispute.

The plaintiffs, in opposing the petition, said “there is no need, or permissible basis, to allow Chicago Title any further appellate review.
