Defense lawyers and prosecutors argued before the New Jersey Supreme Court over whether law enforcement should make witnesses available for cross-examination in pretrial detention hearings for criminal suspects.

Tuesday's oral arguments in State v. Ingram were the latest in a series the court has held as it continues to work out the finer details of the state's new bail reform system, which went into effect Jan. 1. Most defendants are expected to be released pending trial without having to post monetary bail, but prosecutors can seek to have some defendants—particularly those charged with violent crimes or those who have extensive prior records—held until they are tried.

Earlier this month, the court ruled that law enforcement need not engage in full-fledged discovery in pretrial detention hearings, but instead must turn over to the defense all relevant “reports and statements.”
