The New Jersey Supreme Court has agreed to decide whether the Division of Workers' Compensation has jurisdiction over the case of a state resident who was hurt on an out-of-state job site but was at home when he accepted the offer of employment.

The court has agreed to determine whether the Appellate Division erred when it reversed a decision by Workers' Compensation Court Judge George Pollard to dismiss a petition for lack of jurisdiction.

Pollard dismissed the case because the Raymours Furniture Co. warehouse where petitioner Keith Williams' injury occurred is in Suffern, New York. But the appeals court said other factors besides the location where the injury happened should be considered when weighing jurisdiction in a workers' compensation case.
