Two NJ Attorneys Inducted into American College of Trial Lawyers
Edward T. Kole, a partner of Wilentz, Goldman & Spitzer, and Duane Morris partner Eric R. Breslin, have been named fellows of the American College of Trial Lawyers. The induction ceremony took place on March 3, 2018, before an audience of 700 at the 2018 spring meeting in Phoenix, Arizona. Founded in 1950, the college is composed of members of the trial bar from the United States and Canada. Fellowship in the college is extended by invitation only to those experienced trial lawyers of diverse backgrounds, who have mastered the art of advocacy and whose professional careers have been marked by the highest standards of ethical conduct, professionalism, civility and collegiality, according to the organization. Lawyers must have a minimum of 15 years' trial experience before they can be considered.
Kole is a member of the management committee at Wilentz Goldman and chair of the firm's commercial litigation practice. For nearly 30 years, he has been at Wilentz and has practiced commercial litigation in the state and federal courts in New Jersey and throughout the U.S. He serves as first vice president of the Association of the Federal Bar of the State of New Jersey. He is the immediate past chair of the Business and Commercial Litigation Committee of the New Jersey State Bar Association, and previously served as a member of the Appellate Practice Committee and past chair of the Federal Practice and Procedure Committee. He is also a Fellow of the American Bar Foundation and a member of the Lawyers Advisory Committee for the U.S. District Court of the District of New Jersey.
Eric R. Breslin
Breslin is co-chair of the white-collar criminal defense division of Duane Morris' trial practice group in Newark. He concentrates on complex commercial litigation and white-collar criminal litigation, representing a broad range of companies and individuals. Breslin has tried a variety of criminal and civil matters to verdict in state and federal courts in New Jersey and elsewhere. He has also conducted numerous internal investigations for corporate clients. He is a 1982 graduate, with honors, of George Washington University Law School and a graduate of Oberlin College. He is a former judicial clerk to Justice Robert N. Wilentz, chief justice of the New Jersey Supreme Court, and is admitted to practice in New Jersey and New York.
North Hudson Lawyers' Club Offers College Scholarships
The North Hudson Lawyers' Club Foundation announced it is accepting applications for the 2018 North Hudson Lawyers' Club Foundation Scholarship. The scholarship's purpose is to encourage and advance the next generation of leaders of North Hudson County by providing financial assistance to motivated high school seniors intent on pursuing a college degree, according to the organization.
Applicants must account for appropriate academic standards (submit high school transcript), demonstrate financial need (submit FAFSA & college award letter) and be bona fide residents of northern Hudson County (Guttenberg, North Bergen, Union City, Weehawken, & West New York) attending one of the following high schools: Hudson County Schools of Technology, Memorial High School, North Bergen High School, Union City High School or Weehawken High School. Applicants must plan to attend college for the upcoming academic year commencing September 2018 (fall semester) and provide two current letters of recommendation.

Driscoll from Wilmer Cutler Pickering Hale and Dorr have stepped in to represent Symbotic Inc., an A.I.-enabled technology platform that focuses on increasing supply chain efficiency, and other defendants in a pending shareholder derivative lawsuit. The case, filed Oct. 2 in Massachusetts District Court by the Brown Law Firm on behalf of Stephen Austen, accuses certain officers and directors of misleading investors in regard to Symbotic's potential for margin growth by failing to disclose that the company was not equipped to timely deploy its systems or manage expenses through project delays. The case, assigned to U.S. District Judge Nathaniel M. Gorton, is 1:24-cv-12522, Austen v. Cohen et al.

Edmund Polubinski and Marie Killmond of Davis Polk & Wardwell have entered appearances for data platform software development company MongoDB and other defendants in a pending shareholder derivative lawsuit. The action, filed Oct. 7 in New York Southern District Court by the Brown Law Firm, accuses the company's directors and/or officers of falsely expressing confidence in the company’s restructuring of its sales incentive plan and downplaying the severity of decreases in its upfront commitments. The complaint was filed Sept. 4 in Connecticut District Court by attorney Robert M. Berke on behalf of former employee George Edward Steins, who was arrested and charged with employing an unregistered home improvement salesperson. The complaint alleges that had Sunrun informed the Connecticut Department of Consumer Protection that the plaintiff's employment had ended in 2017 and that he no longer held Sunrun's home improvement contractor license, he would not have been hit with charges, which were dismissed in May 2024.
