A federal appeals court has upheld the dismissal of a civil rights lawsuit filed by a New Jersey Transit employee who claimed he was improperly denied a promotion.

The U.S. Court of Appeals for the Third Circuit on Jan. 25 affirmed a New Jersey federal judge’s granting of summary judgment in favor of New Jersey Transit in plaintiff Anthony DeSantis’ lawsuit against the transit agency.
