A party seeking to modify alimony if their former spouse is living with someone else has the burden of showing changed circumstances, even after a series of changes to the state’s alimony statute in 2014, the Appellate Division ruled Thursday.

The appeals court overturned a trial judge’s order of discovery where a suspension of alimony was sought without a prima facie showing of changed circumstances. The party seeking the modification to alimony still has the burden of establishing changed circumstances to warrant a modification of the alimony obligation, the appeals court said.
