A federal appeals court has thrown out a lawsuit challenging New Jersey’s plans to withdraw from the bi-state Waterfront Commission of New York Harbor.
The ruling from the U.S. Court of Appeals for the Third Circuit overturns a trial judge’s decision finding New Jersey could not sever the pact creating the agency without the approval of New York state, or an act of Congress.
